GYPSY STUDIOS MEMBER/PARTICIPANT/CHILDREN RELEASE and WAIVER of LIABILITY, INDEMNITY AGREEMENT, & MEDIA RELEASE 

IN CONSIDERATION of being permitted to utilize the premises, facilities, services and programs of Gypsy Studios, (or for my children to so participate) for any purpose, including, but not limited to observation or use of facilities or equipment, or participation in any off-site program affiliated with Gypsy Studio, the registrant, for himself or herself and such participating children and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has, or immediately upon entering or participating will, inspect and carefully consider such premises and facilities or the affiliated program. It is further warranted that such entry onto Gypsy Studio’s facilities for observation or use of any facilities or equipment or participation in such affiliated program constitutes an acknowledgement that such premises and all facilities and equipment thereon and such affiliated program have been inspected and carefully considered and that the registrant finds and accepts same as being safe and reasonably suited for the purpose of such observation, use or participation by the registrant and such children. 

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER GYPSY STUDIOS FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO OBSERVATION OR USE OF FACILITIES OR EQUIPMENT, OR PARTICIPATION IN ANY OFF-SITE PROGRAM AFFILIATED WITH GYPSY STUDIOS, THE REGISTRANT HEREBY AGREES TO THE FOLLOWING: 

1. THE REGISTRANT ON HIS OR HER BEHALF AND BEHALF OF SUCH CHILDREN, HEREBY RELEASES, WAIVES, DISCHARGES AND CONVENANTS NOT TO SUE Gypsy Studios and all branches thereof; its directors, officers, employees, and agents(hereinafter referred to as “releasees”) from all liability to the registrant or such children and all his personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the registrant or such children whether caused by the negligence of the releasees or otherwise while the registrant or such children is in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with Gypsy Studios.
2. THE REGISTRANT HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any, loss, liability, damage or cost they may, incur due to the presence of the registrant or such children in, upon or about Gypsy Studios’ premises or in any way observing or using any facilities or equipment of Gypsy Studios or participating in any program affiliated with Gypsy Studios whether caused by the negligence of the releasees or otherwise.
3. THE REGISTRANT HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to the registrant or such children due to negligence of releasees or otherwise while in, about or upon the premises of Gypsy Studios and/or while using the premises or any facilities or equipment thereon or participating in any program affiliated with Gypsy Studios.
4. THE REGISTRANT HEREBY DOES DOES NOT Authorize Gypsy Studios and their legal representatives and assigns, the right and permission to photograph, digitally record, videotape, or audio tape, myself or the children set forth below while he or she is a participating in any Gypsy Studios event. I further agree that any or all of the material recorded may be used, in any manner, including in print and electronic publications, audio visual presentations, promotional literature, advertising, or another similar ways, and that such use shall be without payment of fees, royalties, special credit, or other compensation . I understand that all such recordings in whatever medium shall remain the property of Gypsy Studios.

The registrant further expressly agrees that the foregoing RELEASE WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 

THE REGISTRANT HAS READ AND VOLUNTARILY AGREES TO THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.

Gypsy Studios’ Code of Conduct 

Gypsy Studios is committed to providing a safe and welcoming environment for all members and participants. To promote safety and comfort for all, we ask individuals to act appropriately at all times when they are in our facility or participating in our programs. 

Gypsy Studios’ staff members are eager to be of assistance. Members and participants should not hesitate to notify a staff member if assistance is needed. 

1. To assure a safe and pleasant visit at Gypsy Studios:

• All Members and Open Studio participants must agree to the participation terms & conditions.
• Open Studio participants may only participate in their elected project and do not have freedom to use the entire facility. 
• Gypsy Studios is not responsible for lost or stolen items. 
• Any Gypsy Studios property checked out for personal use must be returned in the same condition as borrowed. Appropriate fees will be assessed for broken, lost or stolen items. 
• All equipment must be used in accordance with its intended use. Gypsy Studios’ staff is more than happy to show you how to use and clean equipment properly – please ask for assistance. 
• You’re an artist – you already know you might get dirty. We suggest you wear comfortable clothing and footwear. 
• Members’ children ages 7 years and younger must be accompanied by a responsible adult. 
• Members’ Children 7-18 years old may use the facility unaccompanied, but a parent or responsible adult must be available to pick them up on no more than 15 minutes notice. 
• Follow all posted rules related to specific areas, equipment, and materials. 
• Please follow all posted rules and directions of Gypsy Studios’ staff.
• Treat everyone & everything with RESPECT: this means, others, tools, & yourself. • Respect the workspace of other guests 
  • Use tools safely and for their intended purpose 
  • Keep personal noise to a minimum – use ‘inside voices’ 
  • Do not touch, disturb, damage or play with artwork created by (or being created by) others without their express permission 
  • No roughhousing 

2. Prohibited actions specifically include: 

• Angry or vulgar language, including swearing, name-calling, shouting, speaking negatively about others’ (and your own) work and abilities. 
• Physical contact with another person in any angry, uncomfortable or threatening way. 
• Any demonstration of sexual activity or sexual contact with another person. 
• Harassment or intimidation by words, gestures, body language or other menacing behavior. 
• Interference with respect to the management or operation of Gypsy Studios. 
• Photography, video or audio recording without prior approval of Gypsy Studios’ staff. 
• Theft or behavior that results in the destruction of property. 
• Carrying or concealing any weapons, devices or objects that may be used as weapons. 
• Gypsy Studios and its property is a smoke-free environment and smoking is prohibited on the property. This includes the use of any electronic cigarettes, vaporizers and tobacco products. 

3. Gypsy Studios reserves the right to deny access or membership to any person. Children who have been asked to leave for behavior issues will not be permitted future access to the Studio. 

4. Suspension or termination of Gypsy Studios’ membership privileges or participation may result from a determination by Management if, in their discretion a violation of the Gypsy Studios’ Code of Conduct has occurred or for other compelling reasons. 

5. Gypsy Studios reserves the right to amend this Code of Conduct Policy at any time and member or participant agrees to be bound by the newly adopted regulations.
